Kayak Death On Hudson Was Drinking-Related Accident, Not Murder: Defense

GOSHEN, N.Y. (AP) — A woman accused of killing her fiance on the Hudson River by sabotaging his kayak is a victim of an accident that occurred on the chilly water after they had a couple of drinks, her lawyer said Friday.

Angelika Graswald pleaded not guilty Friday to murder and manslaughter charges in Orange County Court through her lawyer. Defense attorney Richard Portale said after the arraignment that he expects pending autopsy results on Vincent Viafore to indicate accidental drowning, hypothermia and "possible acute alcoholic intoxication."

"I think it's pretty clear that they were drinking, at least had a couple beers," Portale told reporters outside court.

Graswald is charged in the April 19 death of Viafore, whose body was found last weekend in the river near the U.S. Military Academy at West Point.

Prosecutors claim Graswald, 35, removed the drain plug from Viafore's kayak and pushed a floating paddle away from him after his craft capsized and he struggled in the cold, choppy water. They claim she waited 20 minutes to call for help.

Graswald confessed "it felt good knowing he was going to die," prosecutors said. She felt trapped in the relationship and knew she was a beneficiary of a $250,000 life insurance policy, they said.

Graswald said she was unable to save Viafore, 46, when he capsized without a life jacket during their trip to scenic Bannerman Island, about 50 miles north of New York City. She was rescued from the water by another boater and treated for hypothermia.

"Miss Graswald is a victim here and this is an accidental drowning," Portale said.

Christopher Boreck, chief assistant district attorney for Orange County, would not comment on Portale's remarks about Viafore's alleged drinking.

Friends of the couple said Graswald and Viafore were an active, affectionate pair who planned to get married at a spot on the Baltic Sea. She was not charged in his death until more than a week later. Prosecutors say she made inconsistent statement to investigators.

Graswald is being held on $3 million bail.

WASHINGTON — The United States has rescinded a ban on sales of military equipment to the South Pacific island nation of Fiji.

An announcement Friday in the Federal Register said the shift in defense trade policy is in response to credible, democratic elections in Fiji last September. The U.S. had restricted its assistance following a military coup in 2006.

Voreqe Bainimarama, who launched the coup and served as military ruler for eight years, won a decisive victory in the election and is now prime minister.

The Obama administration has stepped up U.S. engagement with Pacific island nations as it vies for regional influence with China.

In October, the U.S. said it was exploring opportunities to resume engaging with Fiji’s military, including in training exercises and in cooperating on issues of global concern.

EPA proposes lowering requirements for ethanol in gas

WASHINGTON — The nation’s gasoline supply likely will have more ethanol in coming years — but not as much as was required by federal law.

The Obama administration’s proposed renewable fuel standard won’t have much of an impact on gas prices, but could become an issue in the 2016 presidential elections, especially in farm states that have profited over the years from higher corn prices linked to the use of corn-based ethanol. Campaigning in Iowa, Democratic presidential candidate Hillary Rodham Clinton has called for a robust renewable fuels standard.

The proposed standards also represent a blow to renewable fuel companies that have pushed to keep high volumes of their product flowing into drivers’ gas tanks.

The 2007 renewable fuels law tried to address global warming, reduce dependence on foreign oil and bolster the rural economy. It required a steady increase in the amount of renewable fuels like corn-based ethanol blended into gasoline over time. The new proposal would reduce the amount required by more than 4 billion gallons in 2015 and by more than 3 billion gallons the following year.

The agency said the standards set by the law cannot be achieved, due partly to limitations on the amount of non-ethanol renewable fuels that can be produced. Next-generation biofuels, made from agricultural waste such as wood chips and corncobs, have not taken off as quickly as Congress required and the administration expected. There has also been less gasoline use than predicted, the Environmental Protection Agency said.

Still, the targets would represent an overall increase in the use of renewable fuels over time. EPA officials said the new requirements would drive growth at an “ambitious but responsible” rate.

“We believe these proposed volume requirements will provide a strong incentive for continued investment and growth in biofuels,” said EPA’s Janet McCabe.

The lower targets are better news for the oil industry, which has fought the existing law. Oil companies say they would prefer that the market determine how much ethanol is blended into their gas.

Tom Buis of the ethanol industry group Growth Energy accused the EPA of siding with the oil companies.

“It is unfortunate that EPA chose to side with the obligated parties who have deliberately refused to live up to their obligation to provide consumers with a choice of fossil fuels or lower cost, higher performing, homegrown renewable energy at the pump,” Buis said.

In a bid to ethanol producers, the administration also announced Friday that the Agriculture Department will invest up to $100 million to help improve infrastructure for delivering ethanol to cars, such as fuel pumps capable of supplying higher blends of renewable fuel.
